Why establish a family trust?
A Family Trust will allow you to place items that you own into a Trust.  Upon your demise all of the assets in the trust pass through to the beneficiaries without probate.  This greatly reduces the burden on your heirs.

How long do I have to respond when served with a complaint?
You have 30 days to file a responsive pleading after you are served with the complaint.  The date of the filing of the complaint has no bearing on your time to respond.  It is 30 days from the date that you receive the complaint.

What are punitive damages?
Punitive damages are damages that are meant to punish.  They are not routinely an issue in Civil cases.  To obtain punitive damages, one must show the culpable party is guilty of recklessness and malice, oppression or fraud.  They are generally award for particularly egregious conduct and can be very and may be based upon the financial condition of a defendant.

Should I establish a corporation for my business?
This is a question with a number of variables.  There are many considerations that must be evaluated such as tax implications, the type of business and expense.  Corporations can protect your family against liability if set up correctly and if corporate documentation is current and correct.  There is more to incorporating than just preparing and filing of the Articles of Incorporation.  The Law Office of Michael R.
